Eben Franckewitz: A Mess on Adele


Oh, how we miss Simon Cowell. He would have torn into Eben Franckewitz last night.

Not that we want to see a 15-year old cry on stage, but let's be honest: this Justin Bieber lookalike is not ready for primetime, and certainly not ready to try his voice on an Adele single.

But that's exactly what Eben attempted, covering "Set Fire to Rain" and simply failing to hit any of the proper notes, while looking overwhelmed on such a grand stage.

No, Randy Jackson, Franckewitz did not "collect himself like a pro," which is understandable: he's not a pro. He's only 15. And he may have a bright future in the business, but he doesn't on season 11 of American Idol.

There exists a certain politics which has become popular in the Bay Area that overemphasizes the micro and discursive components of power at the expense of comprehending and responding to its macro structure.

While the material structure of white supremacist capitalist patriarchy is composed partly of discursive formations (gendered and racialized notions of self and other, presence and absence, gender performativity, etc), it is composed largely of material infrastructure (borders, detention centers, prison cells, riot police, surveilance cameras, tazers, guns, tear gas canisters, factories, freight ships, ports, mines, nuclear reactors, etc).

There is a politic that power can be written away. While the subtle symbolic work of power provides those with the ability to do ?intellectual work? with myriad opportunities for theorizing, any discursive work on the subtleties of power which does not also come into conflict with the material infrastructure of power is simply a ?production of information?.

The greatest break with the symbolic work of power happens in the conflict with the material infrastructure of power which these symbolic formations seek to justify.

When the gestures that mark a material conflict with the infrastructure of power are gendered as ?manarchist,? resistance becomes, in this paradigm, untenable. While it is true that ?to act? is gendered as masculine while ?to be acted upon? is gendered as feminine, it would be a grave error to universally problematize these gestures on which masculinity has been inscribed.

The overturning of heteropatriarchy must not be understood as synonymous with the performace of feminine gendered actions and the avoidance of masculine gendered actions.

This falsehood would have us complicit in the materiality of power for fear of being complicit in its metaphysics. We are already complicit. We must no longer fear the re-emergence of power relations in resistance in such a way that prevents us from engaging in resistance.

It is not the man who attacks the infrastructure of white supremacist capitalist patriarchy that is a patriarch, but the man who defends it.

BOSTON (AP) ? With only eight days to live, a wealthy, ailing Massachusetts merchant wrote in his will 351 years ago that he was leaving a spectacular 35-acre seafront property for the benefit of public school children, decreeing the land should never be sold or wasted.

The dying wish of William Payne, one of the state's earliest settlers, created the nation's oldest charitable trust and eventually led tenants to build 167 cottages ? most of them used by summer vacationers ? on the land he left for the seaside city of Ipswich. The rent money has generated some $2.4 million to help fund public schools over the last 25 years.

Now, the trustees want to tear up the will, convert the property into condominiums and sell them to the tenants to settle a 2006 lawsuit filed by the tenants over rent increases. But hundreds of Ipswich residents have gone to court to block the settlement, saying it violates the sacred intent of Payne's will and shortchanges the schools.

The Massachusetts Appeals Court is considering whether to nullify the settlement and is scheduled to hear arguments in the case March 2.

The residents contend that while independent appraisals show the value of the land is an average of about $41 million, the agreement sets a sale price of nearly $32 million. They also say that the settlement also denies public schools the benefit of rising land value that occurs over the long term and that could help them collect higher rents.

Attorney General Martha Coakley, whose office enforces laws governing public charities, is supporting the settlement approved by a probate court judge in December, saying that the trust is no longer able to carry out Payne's wishes.

Mark Swirbalus, who represents opponents of the settlement, said the case sends a "troubling message" because it shows the intent of someone setting up a trust could be trampled and the rights of beneficiaries could easily be compromised in decisions that do not protect their best interest.

"In short, the agreement to sell the land, and the court's approval of this agreement, seem to have been done for the sake of expedience, regardless of William Payne's intent and Massachusetts law," Swirbalus said.

Residents seeking to block the deal have accused trustees of mismanagement, operating in secrecy and making sporadic and small payments to public schools for years long before the tenants sued over the rent. Disputes over wastewater and other necessary improvement to the land also fueled complaints against the trustees, formally known as Feoffees of the Ipswich Grammar School.

"The fundamental problem in all this is there are a lot of different opinions in town as to whether the trustees are sort of willfully evil or just incompetent," said Douglas DeAngelis, an Ipswich parent and one of the 14 people seeking to join the lawsuit. "But, at the end of the day, you have a $40 million asset that's never been professionally managed."

Payne's land gift was intended to help Ipswich comply with a 1647 colonial law that required communities with more than 100 families to set up a grammar school to prepare students for admission to "the College at Cambridge" ? a reference in his will to Harvard College, founded in 1636 with a mission to prepare young men for the ministry.

The second paragraph of Payne's handwritten will declares in flourishing script: "I giue vnto the free scoole of lpswitch, the little neck of land alt Ipswitch, commonly knowne by the name of Jeferrys neeck. The which is to bee, and remaine, to the benifitt of the said scoole of Ipswitch, for euer, as I haue formerly Intended, and therefore the sayd land not to bee sould nor wasted."

Ed Cafasso, a spokesman for the sale opponents, said the plaintiffs are not only contesting the probate court ruling, but also contend that Coakley "failed to investigate evidence of the charity's mismanagement," including the fact that so little money has been distributed to the schools over the years as well as previous instances in which trustees rented cottages they were managing ? leaving them with little incentive to set rents at market value.

The attorney general's office, however, on Friday defended its decision to support the land sale, saying the trust had become ineffective in serving its stated purpose of aiding Ipswich schools.

"The settlement terms ... comply with charities law and achieve two important goals: First, they restore a much needed revenue stream for the Ipswich schools consistent with William Payne's wishes and ensure the long-term viability and sustainability of his gift in the future," Brad Puffer, spokesman for Coakley, said in a statement.

"Second, they provide for a publicly appointed board to govern the trust that will be created with proceeds from the sale of the Little Neck land," Puffer said. "This change will enhance public accountability and transparency for the trust going forward."

Trustee Peter Foote, who manages affairs on behalf of other trustees, declined to comment.

Attorney William Sheehan, who represents the trustees, said the settlement represents the best option in efforts to ensure that Ipswich schools continue to receive funding from Payne's dying wish.

Suggestions that the trustees have mismanaged the land "and this notion of 'no, we are better off if the property is rented'" ignores the fact that the settlement shifts to condo owners the burden of about $1 million required to fix significant erosion problem that occurred on the land in 2007, Sheehan said.

The settlement also eliminates the uncertainty created by a potential liability from the 2006 lawsuit that tenants filed to block the trustees from evicting them from their cottages for refusing to pay higher rents, Sheehan said.

Can the stock market pick the next president?

The number has been repeated so often by presidential prognosticators that it's an article of faith: No president has been re-elected since World War II with an unemployment rate higher than 7.2 percent.

But the stock market turns out to be a pretty good predictor, too.

The Dow Jones industrial average has soared 62 percent since President Barack Obama took the oath of office during some of the darkest days of the Great Recession. The Dow was just below 8,000 then and stands near 13,000 today.

If a recent study of stock markets and presidential elections is any guide, Obama can start preparing his second inaugural address.

"There's something to this," says Phil Orlando, chief equity market strategist at Federated Investors, the $370 billion investment firm.

There are plenty of other signs often consulted for their political forecasting power, like whether a team from the National Football Conference or the American Football Conference wins the Super Bowl.

This one makes a little more sense: When the economy picks up and unemployment falls, confident investors put money into riskier investments and stocks rise. Voters are likely to reward the sitting president with another four years.

"The stock market reflects trends in the economy," Orlando says. And as any political operative can attest, in a presidential campaign, it's the economy ? you know the rest.

The study was backed by the Socionomics Institute, a think tank studying how a shared mood among a group sways its members' actions. Their researchers dug up data on economic output, prices, unemployment and stock-market performance and matched them to presidential elections.

They went all the way back to the first re-election in 1792, when George Washington beat John Adams and won a second term as the president.

The researchers found a solid connection between the stock market's direction in the three years leading up to Election Day and the election results. Gains of 20 percent or more for the Dow nearly assured victories for sitting presidents. Drops of 10 percent or worse got them tossed out.

Voters returned Calvin Coolidge to the White House in 1924, just as the Roaring '20s started roaring. They booted Herbert Hoover in 1932 while the stock market suffered through a three-year plunge.

The authors of the Socionomics Institute study say everything can be traced back to the prevailing optimism or pessimism. Their organization studies "the social mood." But how do you read the mood of a whole country?

The authors say that the stock market is the best available gauge of how the country is feeling, "because investors can act swiftly to express their optimism or pessimism." Bad day? Time to sell. Things looking up? Time to buy.

"An increasingly positive social mood produces a rising stock market as well as votes for the incumbent, and an increasingly negative social mood produces a falling stock market as well as votes against the incumbent," they write.

To the authors, it's the mood that determines the election, not the stock market. The stock market is just a reliable gauge of the national temper, an incredibly accurate mood ring.

In recent successful re-election campaigns, the connection appears clear. Ronald Reagan won re-election in 1984 following the Dow's 41 percent surge and despite an unemployment rate of 7.2 percent. Bill Clinton was awarded a second term after the Dow gained 63 percent in the three years leading up to Election Day.

But there are misfires. James Madison, for instance, won re-election in 1812 despite a 34 percent drop in the market over three years. George H.W. Bush lost to Bill Clinton even though the Dow rose 51 percent over his term in office.

Doug Wead, a presidential historian who served in the elder Bush's administration, says the stock market theory sounds suspect.

"The stock market isn't even a good indicator of the economy," he says. "You can have the stock market going up while the rich get richer and the poor get poorer."

There's also the danger of oversimplifying ? relying on one number, in this case the Dow's performance, while ignoring everything from scandals and wars to third-party candidates.

In William Howard Taft's last three years in office, the Dow lost 12 percent, and Taft lost the 1912 election to Woodrow Wilson. But if Theodore Roosevelt hadn't split from the Republicans and run under the Progressive Party banner against Taft that year, Taft might have returned to office.

It was a similar story with the first President Bush in 1992. The independent candidate Ross Perot siphoned off votes from both candidates, but historians generally believe more came from Bush's Republican camp. Clinton won with just 43 percent of the popular vote.

The economy also slipped into a recession during Bush's second year in office, and as he campaigned for re-election, the unemployment rate hovered well above the dreaded 7.2 percent mark.

Orlando, of Federated Investors, says a change in any single statistic won't guarantee a president gets re-elected. Analysts should consult a range of figures. One that looks less reassuring for Obama is his approval rating, he says.

No president has been re-elected with a Gallup approval rating below 48 percent approaching Election Day. Obama's numbers are improving, and the election is more than eight months away, but for now he's teetering on the edge ? 48 percent.

COLUMBUS, Ohio (AP) ? John Glenn plans to mark the 50th anniversary of his historic spaceflight with a series of events Monday at Ohio State University, including a celebratory dinner and a chat with the International Space Station.

The astronaut and senator from Ohio became the first American to orbit the Earth on Feb. 20, 1962, circling it three times in five hours and helping to lead the nation into space. The trip helped the United States catch up to the Soviet Union's accomplishments, and Glenn said he thinks it was a turning point for the national psyche.

"It's amazing to me to look back 50 years and think that it's been 50 years," Glenn told The Associated Press last month.

He and NASA administrator Charles Bolden were expected to speak with the space station on Monday to kick off a NASA forum about the agency's future and its role in advancing fields such as science, technology and the economy. Glenn and Annie, his wife of almost seven decades, will cap the day by participating in a student-led question-and-answer session during an evening gala featuring a keynote speech by former astronaut Mark Kelly, the commander of the space shuttle Endeavour's final mission.

Glenn was among the top military test pilots presented in 1959 as the Mercury Seven. The only other surviving Mercury astronaut is Scott Carpenter, who called out the memorable line "Godspeed John Glenn" moments before the rocket ignited for Glenn's spaceflight.

The trip is among the accomplishments that made Glenn, as Ohio State President E. Gordon Gee put it, one of the country's "greatest treasures."

"John Glenn is, quite simply, an extraordinary American patriot," Gee said in a statement ahead of the event. "He is a man of boundless courage, limitless optimism and unswerving honor. I am deeply grateful for this opportunity to celebrate his tremendous achievements and his important leadership at Ohio State."

In 1998, when he was 77, Glenn became the oldest person to fly in space.

Now 90, Glenn is the namesake of a NASA research center in Cleveland and a public affairs school at Ohio State. He's given the university more than a thousand boxloads of materials and artifacts to display, including the hand controller with which he flew the Friendship 7 capsule on that historic orbit 50 years ago.
